Seseorang memang tidak boleh sekonyong-konyong mengambil nama domain sebuah merek yang sudah terkenal secara universal, semisal Coca Cola, atau McDonald’s. Terlebih lagi, mengisi situs itu dengan konten yang sama, dengan tujuan-tujuan komersial.
Tapi, bila seseorang memiliki nama berakhiran McDonald memiliki domain yang sedikit berbeda dengan domain milik restoran internasional McDonald’s, ia masih diperbolehkan Syaratnya, penggunaannya untuk keperluan pribadi, bukan komersial.
Sementara dalam kasus ini, blogger Sony Arianto Kurniawan sama sekali tidak melanggar hak Sony Corp, karena domain sony-ak.com yang dimilikinya sangat relevan dengan namanya. Apalagi, blog tersebut isinya juga tidak bersinggungan secara head-to-head dengan produk-produk milik perusahaan elektronik Sony.
